California Autobroker Agreement

This Autobroker Agreement (the "Agreement") is between you (the "Customer") and Cargwin LLC, doing business as Hunter.Lease ("Hunter.Lease", "we", "us"), a licensed California auto broker, DMV license #21138. You accept this Agreement in the checkout step, where checking the acceptance box and paying the service fee is your electronic signature under the federal E-SIGN Act and the California Uniform Electronic Transactions Act (UETA). Please read it before you pay the service fee.
Hunter.Lease is an independent auto broker. We are not a franchised motor vehicle dealer, we are not a lender, and we do not represent any manufacturer. We arrange the purchase, lease, or financing of a vehicle that you ask us to find, on your behalf, with a franchised dealer in our network.
At your request, we locate the vehicle you want, negotiate the price and terms with a franchised dealer, and help arrange the lease or financing you ask for. The dealer sells or leases the vehicle to you, and a lender, if any, provides the financing. We coordinate the deal; we do not sell you the vehicle and we do not lend you money.
This Agreement covers the specific vehicle and the price identified in your booking at the moment you sign: the vehicle description (year, make, model, trim and, when available, the VIN), the computed payment and the service fee are displayed directly above the acceptance box in the checkout step, and the same details are recorded together with your electronic signature. This Agreement expires 30 days after you sign it, or when the brokered deal completes or is cancelled, whichever comes first. A new booking creates a new agreement for that vehicle.
You may also ask us to source a vehicle we do not have in inventory (a "concierge order"). In that case this Agreement covers your request as you describe it (make, model, budget and preferences) rather than a specific VIN and price, because the vehicle has not been located yet. Section 5 (No guarantee) applies in full: we do not guarantee that a matching vehicle, a specific price, or a financing approval exists. If we cannot source a vehicle that matches your request, the service fee is refunded in full under the Refund Policy. Once we present a specific vehicle on your requested terms, the standard terms of this Agreement apply to that vehicle.
You pay Hunter.Lease no broker fee for arranging your deal, unless a specific dollar fee is disclosed to you and agreed by you in writing before it is charged. Our usual compensation is paid by the selling dealer. The platform service fee described below is not a broker fee.
To submit your exact requested terms to a dealer, we charge the platform service fee shown to you at checkout (currently $95). The service fee pays for our work on your deal, and once you place it the dealer accepts your deal automatically. When the service fee is refunded and when it is earned is governed by our Refund Policy, which controls; in short, it is refunded in full on request any time before you sign the contract at the dealer, and it is earned once you sign. We do not store your card for future charges, and the service fee is a one-time charge, not a subscription.
We do not guarantee a specific vehicle, a specific price, availability, or that any lender will approve financing. Any prequalification or estimate we show is informational only and is not a credit decision. Final terms, and any credit decision, come from the dealer or the lender.
You may withdraw your brokering request at any time by contacting us by email at hello@hunter.lease or by phone at +1 (279) 208-5707. Whether your service fee is refunded is governed by the Refund Policy, which provides a full refund on request any time before you sign the contract at the dealer. Nothing in this Agreement waives your right to dispute a charge with your card issuer.
As your broker, Hunter.Lease (Cargwin LLC) never takes title to or ownership of the vehicle. Title and registration are arranged directly between you, the dealer, and the lender under your lease or purchase paperwork.
Hunter.Lease (Cargwin LLC) maintains the surety bond required of California licensed dealers and autobrokers, in the amount of fifty thousand dollars ($50,000). This bond exists for your protection. If you believe you were financially harmed by our brokering services, you may have recourse against this bond. To make a claim, you may contact the California Department of Motor Vehicles, Occupational Licensing Section, and the surety company below, and you should also consult your own attorney.
By checking the acceptance box and paying the service fee, you agree to this Agreement and adopt that action as your electronic signature. This Agreement incorporates by reference our Terms of Service, Privacy Policy, Financial Privacy Notice, and Refund Policy. If anything in those documents conflicts with this Agreement about the brokering relationship, this Agreement governs; the Refund Policy governs the service fee.
